Commercial Manager – Construction
Role
In your capacity of company Commercial manager you will be reporting directly to the company’s senior management
Coordinate with the Construction Director, Project Manager, and site team in charting out the project objectives and plans, setting cost based performance requirements.
Bringing about optimum utilization of resources- labor, materials and equipment, is in accordance to project budget.
Development of effective communication and mechanism for resolving conflicts among the various participants, suppliers and subcontractors.
Review of Contracts Terms & Condition with respect to the Main Contract, Sub Contract and suppliers
Provides senior-level guidance to assigned personnel, and ensures proficiency and timeliness of all contract administration functions in conjunction with the Project Management.
Participate in meetings including, management, tender, bank, cost control and other meetings that may be required from time to time
Responsibilities
Participate in prime contracts and subcontracts negotiations with a view of spearheading conforming of contracts/subcontracts in coordination with tendering and procurement departments in accordance with company policy/standards.
Play a key role in the project planning and construction programs, cost controls, value engineering, managing the projects budgets, tracking of team expenses and identification of resources.
Identify the elements of projects designs and construction likely to give rise to disputes, variations, EOT and claims, report the same to senior management along with recommendations.
Manage and monitor projects compliance with prime contract terms and conditions, and maintain the projects baseline; review of projects financial data in order to ensure awareness of all projects activities associated with the prime contracts and Identification of opportunities for revenue enhancement.
Manage, reporting, and analyzing all contractual matters related to assigned construction packages, including final payments and retentions.
Ensures all warranties, bonds, insurances, guarantees, etc… are in place and maintained and updated in accordance with the contract specs/requirements.
Manage and administer processing of payments; monitor and review cash flow forecast on a regular basis and update senior management accordingly.
Secure requisite bonding and insurance, and ensure requirements are cascaded down to subcontractors, as required.
Provide operational supervision and technical guidance to contracts/commercial staff and other projects personnel supporting contracts or claims activities; ensure prime contracts provisions are flowed down to subcontractors.
Development and management of a Prime Contract Change Management Procedure, quantifying commercial impacts, defining approval requirements, preparation of variation orders or amendments to the prime contracts.
Manage and monitor subcontractor’s performance with respect to obligations pursuant to the terms set out in the subcontracts agreements; advising management of subcontractors activities affecting prime contract rights and obligations.
Maintaining a continual review of subcontractors progress and providing management with information regarding projected financial or technical difficulties resulting from subcontracts changes and/or claims; resolution of complex subcontracts change requests.
Manage support team to assure contracts effectively managed during the course of the contracts period and ensures its close-out is in accordance with company established procedures.
Attend site meetings with consultant/client whenever deemed necessary and update senior management accordingly.
Support the Tendering Manager in other duties as deemed necessary.
Requirements
Degree in Civil Engineering, Construction Management or related discipline.
Minimum 15 years of experience in UAE/GCC in the commercial/contract management in major construction Projects
Strong knowledge of FIDIC.
Chartered member of MRICS and/or CIArb.
Must have prepared Time Extension, Change order, Variations in Projects.
Knowledge in Business Law and strong commercial background is desirable.
Advanced knowledge of civil / construction industry practices, industry standards, and FIDIC based contracts.
Working knowledge of software typically associated with contracts management such as causeway, GCD, Asentex, ….
Experience working in a similar capacity with main contractor in large construction and/or infrastructure projects.
